Please read these Terms and Conditions ("Terms") carefully before creating an account or using Blooming Poultry (the "Service"). By checking the acceptance box during registration, or by accessing or using the Service in any way, you agree to be bound by these Terms. If you do not agree, do not register for or use the Service.

1. The Service

Blooming Poultry is a record-keeping and management tool for poultry farm operations, including flock, feed, health, mortality, production, sales and financial tracking. The Service is a software tool only. It does not provide veterinary, agricultural, financial, tax, legal or other professional advice, and nothing in the Service should be treated as such. You remain solely responsible for all decisions made about your farm, flocks, finances, staff and operations, whether or not those decisions are informed by data recorded in the Service.

2. Accounts and Eligibility

You must provide accurate registration information and are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You are responsible for the accuracy of all data you or your team members enter into the Service; the Service does not independently verify the data you provide.

3. Free Trial and Pricing

New accounts receive full access to the Service free of charge for a 30-day trial period following account creation. After the trial period, continued access is subject to a Monthly Subscription fee of US $3 and requires the account to be activated; contact us to arrange this. We may change our pricing or introduce additional plans in the future, with reasonable advance notice before any such change takes effect.

4. Acceptable Use

You agree not to misuse the Service, including by attempting to bypass access controls, interfering with the Service's operation, uploading unlawful content, or using the Service in a manner that infringes the rights of others.

5. Third-Party Services

The Service uses third-party providers (such as Google Analytics for usage analytics, and may in the future use Google Ads or similar advertising services) that operate under their own terms and privacy policies. We are not responsible for the availability, content, or practices of third-party services.

6. Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, or uninterrupted or error-free operation. We do not warrant that the Service will meet your requirements, that data will never be lost or corrupted, or that any calculations, reports, or figures generated by the Service are accurate or complete. You use the Service, and rely on any output it produces, entirely at your own risk.

7. Limitation of Liability

To the maximum extent permitted by applicable law: neither Blooming Poultry nor its owners, operators, employees, or agents will be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, business, goodwill, data, livestock, or anticipated savings, arising out of or relating to your access to or use of, or inability to access or use, the Service, whether based on contract, tort (including negligence), strict liability, or any other legal theory, even if advised of the possibility of such damages.

To the maximum extent permitted by applicable law, our total aggregate liability arising out of or relating to the Service will not exceed the greater of (a) the total amount you paid us for the Service in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred US dollars (US $100).

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law, including (where applicable) liability for death or personal injury caused by our negligence, or for our fraud or fraudulent misrepresentation. If you are a consumer in a jurisdiction that grants you non-waivable statutory rights, these Terms do not affect those rights, and the limitations above apply only to the extent permitted in your jurisdiction.

8. Your Responsibility and Indemnification

You are solely responsible for the operation of your farm business, including animal welfare, biosecurity, staffing, and compliance with applicable agricultural, labor, tax, and other laws. The Service is a tool to help you keep records; it does not manage your farm for you. You agree to indemnify and hold harmless Blooming Poultry and its owners, operators, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your data, your violation of these Terms, or your violation of any law or the rights of a third party.

9. Termination

We may suspend or terminate your access to the Service for violation of these Terms or for non-payment of applicable fees. You may stop using the Service at any time.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms. Material changes will be communicated through the Service or by email where practical.
